Wrongful Death

Shreveport / Bossier City Wrongful Death Lawyers

A loved one's wrongful death has a devastating effect on a family, both emotionally and financially. While nothing can bring your loved one back, our wrongful death lawyers can hold the responsible party accountable and obtain compensation for the survivors.

There are two causes of action in a death that occur due to the negligence of another party. The first is a wrongful death lawsuit, which includes recovery for lost wages, lost companionship, medical expenses incurred prior to death, and burial expenses. The second is a survival action, which compensates the victim's estate for the suffering of the deceased prior to death.

To find out your rights if your loved one was killed in a Louisiana accident, contact the wrongful death attorneys at Weems, Schimpf, Haines, Landry, Shemwell & Moore (APLC).

Who Can Collect Wrongful Death Compensation?

Louisiana has special rules about who can recover compensation in the event of a wrongful death. Under these rules, there are four types of relatives who can file a lawsuit and collect compensation:

  • The victim's spouse and children
  • The victim's parents
  • The victim's brothers and sisters
  • The victim's grandparents

If anyone survives in a class of relatives that is closer to the victim than yours, you cannot file a wrongful death lawsuit. For example, if you are the victim's mother and the victim has a surviving spouse, the spouse can file a lawsuit but you cannot.

We have successfully handled wrongful death actions that involved car accidents, trucking collisions, motorcycle crashes, construction accidents, premises liability, and other fatal types of accidents. For example, our lawyers obtained $1 million for the family members of a man who died when a conveyor belt collapsed at a lignite mine in Desoto Parish. Our lawyers also made a recovery for a man who died after he was served excessive amounts of alcohol at a gambling establishment (casino) in Shreveport.
